This website is operated by Photomax("Photomax", "we", "us"), a business based in New Delhi, India. By accessing or using photomax.in (the "Site") or placing an order, you agree to these Terms & Conditions. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to purchase from us. By placing an order you confirm that the information you provide is accurate and complete.

2. Products and availability

• All products are subject to availability. We may limit quantities, discontinue a product, or refuse or cancel an order at our discretion.
• We try to display product colours, specifications and images accurately, but actual products may vary slightly. Manufacturer specifications may change without notice.
• Accessories are listed with compatibility guidance for reference only. You are responsible for confirming compatibility with your equipment before purchase; our support team is happy to help.

3. Pricing and payment

• All prices are in Indian Rupees (₹) and inclusive of applicable taxes unless stated otherwise. An invoice is issued with every order; a GST tax invoice is available to GST-registered buyers on request.
• Prices, offers and discounts may change at any time before you place an order. The price applicable to your order is the one displayed at the time of checkout.
• We accept payments through Razorpay (UPI, credit/debit cards, netbanking and wallets) and Cash on Delivery (COD) where available. A COD handling fee may apply and is shown at checkout.
• In the rare event of a product being mispriced, we will contact you before dispatch and give you the option to reconfirm at the correct price or cancel for a full refund.

4. Order acceptance

Your order is an offer to buy. A confirmation email acknowledges receipt of your order but does not amount to acceptance. The contract is formed only when we dispatch the products. If we cannot accept your order we will notify you and refund any amount paid.

5. Shipping, returns and refunds

Delivery is governed by our Shipping Policy and returns/refunds by our Return & Refund Policy, both of which form part of these Terms.

6. Warranty

• Products carry the manufacturer's warranty where applicable. The warranty period and terms are set by the manufacturer.
• Warranty does not cover damage from misuse, accidental damage, water ingress beyond the rated level, unauthorised repair, or normal wear.
• To claim warranty, contact us at contact@photomax.in with your order number and a description of the fault.

7. User accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms or are used for fraudulent activity.

8. Acceptable use

You agree not to:

• use the Site for any unlawful purpose or in breach of these Terms;
• attempt to gain unauthorised access to the Site, its servers or databases;
• scrape, copy or resell Site content, or place orders using automated means or with false information;
• post reviews or content that is defamatory, misleading, infringing or offensive.

9. Intellectual property

All content on the Site — text, graphics, logos, images and the "Photomax" name and marks — is owned by or licensed to us and protected by Indian and international IP laws. You may not use it without our prior written permission.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including loss of income, data, or opportunity, or for losses arising from your use of a product in a professional engagement.

11. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these Terms or your misuse of the Site or products.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to the arbitration clause below, the courts at New Delhi shall have exclusive jurisdiction.

13. Dispute resolution

Any dispute that cannot be resolved amicably within 30 days shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be New Delhi and the language English.

14. Changes to these Terms

We may update these Terms from time to time. The version in force is the one published on this page when you place your order. Material changes will be highlighted on the Site.
